Batch Tagging Option Starts in June

The Oregon Liquor & Cannabis Commission is providing the following information to recreational marijuana licensees.

Marijuana licensees and laboratory licensees are responsible for reading, understanding, and complying with all applicable rules. This bulletin does not supersede any OLCC rule. If you do not understand it, please contact the OLCC for help.

This information bulletin covers the following issues:

  • Batch-tagging option in Metrc

Metrc plans to publish bulletins with more information on the new feature in May. Metrc will also offer an on-demand training session in Metrc Learn (https://learn.metrc.com/) around the end of April. 

Key Dates 

  • April 18: Rules approved by the OLCC
  • April 18 to June 17: Non-flowering outdoor plants over 36 inches tall do not have to be tagged unless they are flowering.
  • April 29: Metrc Learn will have training available
  • Early-to-mid May: Bulletins published with additional information
  • May 20: Group plant tag pre-orders open
  • June 17: Plant batch tagging begins in Metrc

METRC Auto Sync Update

Faster Uploads: We've sped up the Upload Sales to METRC page!

Edited Sales Now Sync to METRC: Users who manually upload sales to METRC will see a new status on the Upload Sales to METRC page. The "Updated" status will appear next to sales that have been edited. Sales with this Updated label will find and update related METRC receipts.

Voids Now Sync to METRC: Now when you void a sale in Marijuana Software, that sale will also void any existing METRC receipt.   

Updated METRC Limits for Oregon: We've synced our system with the latest METRC categories and sales limits.

New Tax-Exempt Customer setting: We have added the ability to mark customers as exempt from tax1 or tax2.

Important Update from the Marijuana Software Team

Hello Everyone,

We hope you're doing well. We wanted to let you know about an important issue with our software that you need to be aware of.

Here's What Happened: On January 3rd, 2024, we rolled out a big update aimed at improving how our system reports sales to METRC. Unfortunately, we ran into some problems. From January 10th to January 28th, 2024, our system mistakenly sent out the same sales information more than once to METRC for many of our users. This glitch caused some trouble with inventory records, making it seem like there was less stock than there actually was, leading to some numbers dropping into the negative.

We've Fixed It: Don't worry, we've tackled this issue head-on and have already fixed it in our system. To help you adjust any affected sales records, we've prepared a guide on using the "METRC Sale Day Reset" button. You can watch a helpful video about it below. And if you're still stuck or have any questions, give us a call at (971) 276 - 3371. We're here to help.

What Else Is New?

  • Smarter METRC Sales Reporting: Now, when you update a sale in our software, the changes are automatically sent to METRC.
  • Enhanced Debit/Credit Card Support: We've improved how we handle PIN debit transactions to make things smoother.
  • Cash vs. Credit Report: Easily see your cash and credit sales totals at a glance.
  • Quick Cash Recommendations: Our POS system now suggests cash amounts when you're wrapping up a sale, making it quicker to give change.
  • Heads-Up on Pending Sales: A new alert will pop up in our software to remind you of sales that need to be reported to METRC.

Improved METRC Integration

Important Update: Improved METRC Integration and Fixes in Marijuana Software

Date: January 3, 2024

We updated our METRC sales reporting system today. This makes it easier to match your Marijuana Software sales with METRC records. Now, when you change a sale that's already in METRC, the METRC receipt will update too.

Noticed Issues & Solutions:

  1. Duplicate Sales: Some of you saw double sales in METRC. We've fixed this. To correct past sales, use the METRC Sales Reconciliation tool to check yesterday's sales.
  2. Caregiver Sales Upload Issue: There was a problem uploading sales from caregivers. It's fixed now. To fix affected sales, go to the 'upload sales to METRC' page, click the order number, edit the sale, and hit 'Close Sale'. Then you can upload it to METRC.

New Tax Compliance Certificate Rules Take Effect Today

JUSTIFICATION OF TEMPORARY FILING:
(1) The Oregon Liquor and Cannabis Commission is planning to adopt a temporary rule to require applicants for new
and renewal cannabis retail licenses to provide a certificate of tax compliance to the commission pursuant to the May
16th, 2023 Governor’s Directive to OLCC related to the regulation of cannabis retailers and state tax compliance for
new or renewed cannabis retail licenses. Certificates of tax compliance will also be required for changes of ownership
and certain changes in business structures. If the Department of Revenue does not promptly amend the rule to include
the provisions regarding obtaining a certificate of tax compliance, applicants will be seriously prejudiced by having no
guidance on the process or the circumstances under which the department will approve or deny a request for a tax
compliance certificate. There are also other state programs that require a certificate of tax compliance, and the
department needs to provide guidance on the tax certification process and criteria for those programs as well. In
addition, the rule amendment is needed to clarify the process for a taxpayer to provide a self-certification regarding
their tax compliance under the Public Contracting Code and ORS 305.385.
(2) Cannabis retailers, along with other program applicants required to obtain a certificate of tax compliance, will suffer
if they are unable to operate due to their inability to obtain a tax compliance certificate through failure to understand
the process or criteria for obtaining the certificate.
(3) If the department fails to amend the rule, cannabis retailers would be required to seek a certification of tax
compliance, pursuant to OLCC requirements, but would not have a clearly laid out process and guidance on how they
can qualify as being in tax compliance.
(4) The proposed rule amendment will provide clear guidelines to applicants on how and when the department will issue
a tax compliance certificate and when the department will not certify tax compliance.

OLCC releases biennial report to Oregon’s Legislature

 

PORTLAND, Ore. – The Oregon Liquor and Cannabis Commission (OLCC) today submitted to the Oregon Legislature the 2023 Marijuana Supply and Demand report reflecting the quantity of cannabis available in Oregon’s legal commercial market. This is the fourth biennial report produced by the OLCC, and it shows a similar pattern as in previous reports, that supply still outpaces demand.

In 2022, the demand for legal cannabis products was 63% of supply, compared to 52% of supply in 2021. This difference is likely a reflection of cannabis producers planting less crop in 2022 after a record harvest in 2021 led to plunging prices.

While the self-correction in the market has led to a closer balance in annual supply and demand, it also reveals the precarious economic position of Oregon’s cannabis industry. Declining prices combined with slower growth in consumer purchasing resulted in the first-ever decrease in sales, from $1.2 billion in 2021 to $994 million in 2022.

Declining wholesale and retail prices for usable marijuana can be attributed to the build-up of supply from previous years, and the slowdown in converting usable marijuana (flower) into more shelf-stable THC products like edibles, oil and tinctures. The leftover supply of both usable marijuana and value-added THC products is likely to continue the downward pressure on prices.

Final Implementation of New Additive Rules takes effect July 1 2021

The July 1, 2021 deadline for “Inhalable Cannabinoid Products with Non-cannabis Additives” (“ICP”) is rapidly approaching.  Generally, ICPs are vape cartridges and pre-rolls with non-cannabis terpenes or flavorings. On and after July 1, 2021, licensees cannot possess or transfer these products unless they comply with the new rule standards.

Before July 1, 2021, licensees can sell, destroy (waste), or return to the processor any ICPs that do not comply with the new rules – but if returning to another licensee, the ICPs will still need to be wasted in compliance with OLCC rules prior to July 1, 2021.

Licensees can use the following to spot labels subject to the “sell down” (cannot be possessed or transferred on and after July 1, 2021) and what labels are not subject to the sell down:

  • Labels subject to the sell down contain product identities like “marijuana extract with non-marijuana terpenes” or “marijuana extract with natural and artificial flavors” and ingredient listings that state “natural” or “artificial flavors.” Here is an example;
  • Labels that are NOT subject to the sell down contain product identities and ingredient listings that contain the words “non-cannabis additives” and list all the ingredients in the product – either on an insert or on the exterior label. Here is an example.
  • Licensees may no longer utilize generic labels for ICPs created on and after April 1, 2021.

Floating Penny Bug Fix

OMMPOS has had a long running bug on our sales screen where the system would add a penny too much or calculate taxes and be a penny short. We have fixed this issue. It may be necessary to reenter your product prices for products where this issue is happening.

We have applied this update to regular OMMPOS today and will update Private Cloud customers tomorrow. Stand Alone Backup Server customers should give us a call to schedule an upgrade. Please give me a call with any questions. - Raja (971) 276 - 3371

Pre Roll Button Fixed

We fixed the METRC Pre-roll button. A recent METRC change requires specifying a Room when creating a new package. The pre-roll button will now create a default room for your dispensary if one has not already been specified.

OMMPOS Delivery Support

Today OMMPOS received a new METRC API giving us Delivery Permission. We have posted an update that includes our OMMPOS Delivery BETA. You will find this new feature on the Sales screen.

Change to Wireless Printing

We have changed the way Wireless Printing labels are formatted. Now, you can format wireless labels the way that you like and include any additional required information.

New Reports

We have added new multi-store reports, new budtender reports and restored the Adjustments report. We plan to add a few more reports in coming days.

OMMPOS March 16th Update

Yesterday Metrc performed an update that broke the API functionality of OMMPOS, causing issues with retrieving package information and updating METRC admin information. We were able to provide a patch for this issue and uploaded our update to regular OMMPOS this morning. We will upload the patch to OMMPOS Private Clouds and State customers this evening and schedule appointments for Stand Alone Backup Server customers. 

We were not provided with advanced notice of yesterday's breaking changes and responded as fast as possible to provide a fix and restore functionality. We worked through the night and were able to restore full functionality to everything except the Metrc Sales Reconciliation Tool. This past METRC update removes access to key sales transaction data that we need to reconcile daily sales. We will be reaching out to Metrc asking them to restore the sales transaction data that we need for daily sales reconciliation and we encourage you to do the same.

Metrc Update Causing Package Issues

update 3/16/21 3:16 AM: We updated regular OMMPOS this morning. Yesterday Metrc posted an update that caused breaking changes. We updated OMMPOS to account for these changes. We will be updating Private Clouds end of day Tuesday 3/16/21. Backup server customers please contact me to schedule an upgrade appointment. - Raja

METRC launched it's scheduled update this morning mentioned in metrc memo #90.  This update appears to be interrupting people's ability to import new packages. If you encounter this issue please give METRC a call and let them know. 

We are postponing our planned update until this Friday 3/19/21 to avoid any conflict with this METRC update. Please give me a call with any questions.

Today OMMPOS experienced a service slow down from approx. 4 to 9pm PST. We traced the cause to an outage in Microsoft's west coast datacenter. Bug Fix to Wireless Printing

A major update is scheduled for tomorrow Monday November 2nd

  • Correction to HEMP & CBD Taxation. OMMPOS has been mistakenly including HEMP and CBD only items in tax reports. This may have resulted in an inflated tax report. This error has been corrected as of 10/1/2020. Quarterly returns filed before this date should be refiled. 
  • Correction to the Caregiver Sales Limits. Our understanding of the new OLCC rules was not correct. We set OMMPOS up to limit patients and caregivers to a maximum combined 32 ounces per month. Based on updated OLCC guidance, we have updated this limit to 32oz per month for patients and an additional 32oz per month for caregivers. 
  • New Farm Tools BETA available. Our first release of Metrc Farm Tools is publicly available. Manage your Metrc grow compliance directly from OMMPOS
  • A recent Windows update has broken FireFox’s ability to print labels. To workaround this issue change your Firefox PDF options to download PDFs instead of opening them in Firefox. 
  • New Billing System. OMMPOS uses a new automated billing system. Your bill becomes available from the OMMPOS homepage on the 1st of every month. 
  • Office Hours. Customer support is included in your OMMPOS plan. Please call us anytime Monday to Saturday 10 AM to 6 PM with questions. We are happy to help.

Caregiver Update

We added a new patient type 'CAREGIVER' to comply with the new OLCC guidelines. When entering a new caregiver:

  • Go to Sales
  • Click New Customer
  • Set the customer type to CAREGIVER
  • Fill in the Caregiver name as the patient name, then fill in all of the patient and caregiver information
  • Ring the sale up with the Caregiver as the patient
  • OMMPOS will post the caregiver sale to METRC at reporting time

System Slowness Fixed

We received reports of extreme system slowness this morning and afternoon. We traced the problem to our online ordering report notification system and have temporarily taken it offline. Notice from METRC on Outages and Scheduled Updates

Over the past few months, the Metrc system has been experiencing sporadic system

performance issues in some states. We recognize that these issues in some cases have grown

more frequent, causing longer load times and error messages then optimal. We

have determined two primary causes behind these issues:

1) Increasingly frequent API calls by third-party integrators. In certain instances, misuse of

the API can cause a slowdown for other users, effectively clogging Metrc with

unnecessary data requests.

 

2) Large amount of active data in licensee accounts. Active sales receipt, package and

transfer data sets have grown quite large in some states. As these data sets become

larger, day to day functions can be impacted as the system has to work through large

portions of data that is no longer being used. In some cases, users have several years of

data contained in their respective accounts that is no longer being used, but is part of

their active data sets.

 

Starting July 20, Metrc will begin a series of system updates and production releases to enhance

our software and make the system faster and easier to use. See below for a summary and brief

timeline of these enhancements.

 

Production Release (7/20)

The upcoming production release is currently in our final testing stages and is primarily focused

on fixes. We release API Bulletin 69 that details the API impacts in the 7/20 release. If the

bulletin was missed by a vendor, please reach out to api-info@metrc.com.

 

System Maintenance (7/21)

Metrc will be conducting system maintenance in preparation for the upcoming rate limiting and

data optimization efforts. This required maintenance may impact system performance

between 8 to 11 AM CT in all Metrc instances. We encourage vendors to avoid any type of

synchronization/reconciliation jobs during that window. We do not expect Metrc to be 

Metrc API Bulletin unavailable during that window, and if you experience any issues, please reach out to apiinfo@metrc.com.

 

Rate Limiting (tentatively scheduled for the last week of July)

We will also be implementing an API best practice known as rate limiting later this month. Rate

limiting caps the number of API calls a third-party integrator can make in a given amount of

time to ensure all integrators are given an equal playing field and no single user or company

being able to overwhelm the system.

 

Data Optimization (tentatively scheduled for the first week of August)

We will begin moving historical data – data that is finalized or finished – to separate locations to

further optimize system performance. Once the optimization is complete, system users and

vendors will still be able to access that data within the UI and API. Users will still be able to unfinalize or un-finish data if necessary.

 

In order to maximize the benefits of data optimization, users are encouraged to finalize or finish

sales receipts and packages that are no longer active. Metrc has provided users the ability to

finalize sales, finish both packages and harvests. If you have any questions or need help with

this process, please reach out to api-info@metrc.com.

 

We will send additional communications about these enhancements and of any impacts they

may have on daily operations over the coming weeks.

Understanding OMMPOS Billing

OMMPOS Billing works like a utility with your bill being higher in very active months and lower in slow months. 

The chart above shows how our billing plan works. OMMPOS bills you based on the number of completed sales transactions that you put through the system in the previous month. A transaction is one thing (SKU) sold in a completed order. For example an order with an Eighth, a bong and a joint is 3 transactions. Adjustments, voids and canceled sales do not count against this total. 

Dispensaries who sell less than 700 things in a calendar month only pay $50. Dispensaries who sell less 2,400 things in a month pay $75 for that month and so on. This plan mirrors the way that we pay our hosting provider, Microsoft and allows us to make OMMPOS the most affordable point of sale in the industry.

We recently patched the following issues

  • The Pre-roll button has been fixed
  • The Quarterly tax report has been updated to match the new DOR format. Quaters before Q1 2020 must be emailed to the DOR.
  • We added the OLD monthly tax report so that you can generate it for your own records
  • The Sales CSV had a bug where discounts were not applied to totals. This has been fixed.
  • The New API had a bug where the last sale of the day was not being reported. This has been fixed.
  • The new API had a bug where product changes were not being copied to the web menu. This has been fixed.
  • The Patient sales limit has been increased to the OLCC daily maximum.
  • The METRC Sales reconciliation tool has been updated to fix an issue that was preventing it from matching records.
  • We fixed an issue when importing METRC packages measured in Pounds.

Quarterly Tax Report Update and Bug Fixes

We uploaded several critical updates today. OMMPOS and Private Cloud servers have been updated. Backup server customers should call me to schedule an update.

  • The Oregon DOR recently made a change to the way quarterly reporting works. We have updated our quaterly DOR report to account for this change. We have also added links to future quarterly reports so that you can preview your upcoming tax information.
  • We fixed a bug that prevented setting tiered pricing when the Metrc package is set to Pounds.
  • We fixed a minor bug in the new API Web Menu.
  • We fixed a bug that was preventing the METRC Sales reconciliation tool from working.

Marijuana Retail Licensees Allowed to Provide Curbside Delivery

Portland, OR --  Today the Oregon Liquor Control Commission approved a temporary rule that supports social distancing to promote prevention of the spread of the COVID-19 virus, by allowing licensed marijuana retailers to conduct limited transactions outside their licensed premises.  The action will permit retail licensees to take orders and deliver product from the retail store to a person who is outside of the store and within 150 feet of the retailer’s licensed premises.

 

At an emergency meeting to consider temporary rules impacting the business activity of OLCC licensees in the alcohol and marijuana industry, the Commission took its action to promote social distancing in the wake of the COVID-19 virus.  The Commission’s action aligns with the Governor’s Executive Order that prohibits public gatherings of 25 people or more, and encourages people to distance themselves by at least 3 feet while in public. 

 

The temporary rule also increases the amount of flower that OMMP cardholders and caregivers can purchase to 24 ounces per day and no more than 32 ounces per month. This change temporarily increases the daily purchase limit for OMMP cardholders to match their personal possession limit. This rule does not change the total monthly amount a cardholder or caregiver is currently permitted to purchase from an OLCC-licensed retailer.

 

The temporary action that the Commission has taken is designed to balance the protection of public health while at the same time helping struggling businesses.  Marijuana industry guidance can be found here.

Logout and Daylight Savings Fix

We are happy to announce that we have permanently fixed the clock issue for daylight savings time. The system should automatically update itself now when the switch over occurs.

We have fixed the timecard spontaneous clock out issue.

We fixed an issue preventing some users from logging out. A recent windows update affected the way web browser cookies work in Chrome and Firefox. The result was that some users could not log out or switch stores. This issue has been fixed.

Upcoming fixes
We are adding price tiers to Hemp products and fixing a reported hemp taxation issue. If you encounter any issue, please let us know.

OLCC Bulletin on Marijuana Labeling Requirements

Recently the OLCC released a bulletin describing requirements for labeling Marijuana packaging. In the bulletin the OLCC also described the requirement for "generic labels." OMMPOS uses generic labels, produced at the time of sale. These labels pull from the test results information that you enter into the system to produce compliant generic labels. To the best of our knowledge our OMMPOS generic labels comply with all OLCC labeling requirements. If you have any questions or spot anything missing from our labels please give us a call and let us know.

New Multi-Store Support Feature

We have add a new feature for stores with multiple locations. The multi-store support feature enables you to easily switch between locations, or to assign employees to just one location. Easily check stock levels and sales reports between multiple locations. Assign which staff have "Enterprise Admin" permissions. Contact Raja with questions.

Improved Timecard Support

We are continuing to improve our employee timecard tracking. Recently we added a new Time zone field to your store settings. We fixed an issue displaying the incorrect time zone and another issue that made it difficult to manually edit the clock in times.

Notice About Recent METRC Sales Errors

Beginning on December 19th we began to receive reports that the OMMPOS Metrc Sales Upload tool and the OMMPOS Metrc Sales Reconciliation tools were returning errors .

 

We confirmed that sales were being posted to METRC multiple times from the upload page. We posted a fix to this issue on 12/19/19, 12/20/19 and today 12/24/19.

 

We have tested both uploading sales to METRC and using the Metrc Sales Reconciliation tool's ability to correct discrepancies. Both tools now appear to be working correctly.

Both regular OMMPOS customers and Private Cloud customers have received the update. OMMPOS Backup Server customers should call to schedule updates.

Recommended actions for correcting any discrepancies

 

  • Archive sales on the Upload Sales to METRC page
  • Use the METRC Sales Reconciliation Tool to reconcile daily sales from 12/19/19 - 12/23/19
  • Use the View Unmatched Sales button on this page to pair any remaining sales and then void outstanding METRC sales to fully reconcile METRC sales and inventory

METRC UPLOAD ERROR FIXED

UPDATE 12/19/19 6:15PM Yesterday an unexpected change from METRC caused errors on our Metrc sales upload page and the Metrc Sales Reconciliation tool. We posted a fix yesterday afternoon that fixed the Metrc upload page but we received reports that there were still errors. We have just posted an update that should resolve all issues with Metrc uploading and also fixes the Metrc Sales Reconciliation page.

12/18/2019 11:52:41 AM At 10am this morning we became aware that the METRC sales upload page was returning an error message for all of our users. The cause of this error was a change that METRC made to the sales upload process. We did not receive any notice about this change to METRC. It took us 2 hours to update OMMPOS to fix the problem. We are sorry for the delay. If you attempted to upload your sales more than once you may have uploaded duplicate sales to METRC. This issue can be fixed using the METRC sales reconcilliation tool. Metrc Sales Reconciliation Tool Update

Before now the tool had a hard time reconciling joints because of the unit weight. We have fixed this issue and the Metrc Sales Reconciliation tool now correctly reconciles pre-rolls.

Label and Report Server Outage (Repaired)

UPDATE 5:40 pmWe have completely restored label and report printing. Barcode printing is now available again.

What happened? Yesterday at 7pm the label and reports server began to slow down and then fail. We immediately begin trying to fix the issue and contacted Microsoft Tech support. When we were not able to resolve the issue right away we began working on creating a backup label and report server. We brought that backup server online at 8:37 am. We worked with Microsoft through out the day to fix the original server and we have now brought that server back online. We now have a backup Label and Reports server in case of emergencies. OLCC Action on Governor Brown’s Vaping Executive Order

Commission Will Meet to Pass Emergency Temporary Rules

 

Portland, OR -- The Oregon Liquor Control Commission (OLCC) will meet next week to act on the Executive Order on the Vaping Public Health Crisis issued today by Oregon Governor Kate Brown.  The Governor’s order directs the Oregon Health Authority (OHA) and the OLCC to enact a temporary ban on the sale of flavored vaping products, as well as other sources or additives that public health investigators link to the vaping-related illness.

 

Governor Brown emphasized protecting Oregonians’ health as the primary focus of her action, by removing possibly unsafe products from the marketplace, discouraging vaping by children and youth, and reducing human exposure to potentially dangerous chemicals. 

 

Brown further encouraged Oregonians to stop using vaping products until more is known about the cause of the respiratory illness.  The Governor also called on the Federal Drug Administration (FDA) to step in to regulate flavored vaping products and additives.

 

The order directs both agencies to enact a 180-day ban on all flavored vaping products and to develop plans within 90 days to address consumer warnings about the dangers of vaping, vaping product ingredient disclosure, product safety tests of vaping equipment, improved health care provider reporting of vaping lung injuries to OHA, and creating a statewide prevention and education campaign aimed at discouraging the use of vaping products.

 

The Governor is also asking the agencies to develop proposals for long-term solutions to present to the Legislature during the 2020 legislative session.  Governor Brown will include the OLCC in a Vaping Public Health Workgroup tasked with studying the vaping illness crisis and making recommendations to the legislature.

 

“We will act quickly on the Governor’s directive to address this growing public health crisis,” said Steve Marks, OLCC Executive Director.  “The OLCC will utilize the real-time findings of public health officials here in Oregon and across the country as they continue their investigation into the cause of the vaping respiratory illness outbreak.  We’ll let scientists guide us as we contemplate taking additional actions with a measured approach.”

 

The OLCC Commission will act on temporary rules proposing to ban licensed marijuana retailers from selling any cannabinoid (marijuana and hemp) products containing any flavor, including non-marijuana terpenes.  In this interpretation the OLCC does not include terpenes derived from marijuana as a “flavor.”  The temporary rule will also prohibit licensed processors from manufacturing or distributing those same products.

 

After the Commission acts the OLCC will provide further guidance to licensees about taking inventory of flavored or non-marijuana terpene-containing products, removing them from retail store shelves and setting those items aside.  The OLCC will make compliance checks at licensed processors and retailers to make sure affected product is not being offered for sale.

Raja Afrika Selected for OLCC RAC

I was selected to participate in the OLCC's Rules Advisory Committee (RAC) on Metrics and Tracking. There were maybe 60 people in the room which was packed with industry stake holders, producers, processors, wholesalers, the OMMP, the OLCC and the public. The audience was about 60% male, 40% female, and 3 brown people, me included. The purpose of the meeting was to review draft language changes to the Division 25 Rules Package. Mostly the changes to the rule’s language seemed intended to clarify and bring things into line with the OMMP. Some interesting parts of the dialog centered around

- The Medical Bump-up provision, allowing OLCC producers to grow Cannabis for OMMP medical patients. The provision allows producers to dedicate up to 10% of their canopy to grow cannabis for OMMP patients and allowing the producer to keep 25% of their yield for re-sell. ORS 845-025-2500

- Also did you know that OMMP grow sites can transfer up to 20lbs per year to OLCC retailers? Very exciting.

- There was a lot of discussion about allowing delivery drivers up to 96 hours to complete round-robin style delivery manifests where a delivery is manifested from and to the same location but on a route that takes it past several delivery stops.

Official DOR Response to Marijuana Tax Issue

We received an official response from the Oregon Department of Revenue regarding the Marijuana Taxation issue and the OMMPOS METRC Sales Reconciliation tool. First a quick timeline.

  • OMMPOS was the first Oregon company to begin reporting to METRC in 2016.
  • OMMPOS reported GROSS sales values to METRC and NET sales values through our Instant Tax E-file tool from Q2 2016 - Q1 2019.
  • In May 2019 we received reports that stores were being taxed at a higher tax rate than they should have been.
  • We create the METRC Sales Reconciliation Tool to enable retailers to correct their METRC sales receipts to match their OMMPOS sales receipts.

Yesterday the Oregon Department of Revenue responded to us to let us know that they have been receiving a lot of phone calls with questions about this issue. They wanted us to let you know that

  • No customers of OMMPOS or any other point of sales system are being taxed at a higher rate than what their sales records indicate. We rely on taxpayers to correctly report their sales information and are grateful for your continued partnership in that goal
  • When we identify a deficiency in the course of an audit we do not necessarily know which point of sales system the retailer is using (and some retailers switch point of sales systems in the course of their business).  In the course of several audits within the past year we identified that the sales figures getting reported to OLCC from some retailers did not match the sales figures reported on returns. When retailers provided point of sales records detailing actual sales that corresponded to their returns, we reversed deficiencies.

OMMPOS *NEW* Faster way to archive packages

Step-by-step info on an improved method to archive packages.

  • Login & click on products
  • Click on the amount listed under the Inventory column
  • You will see a small drop down menu and a link in blue saying "Archive Packages"
  •  A box will pop-up asking you to confirm. Click OK to proceed
  • All done! You have now successfully archived a package & hopefully saved some time in the process!

Updates and Bug Fixes

  • The new label feature failed to include strain and vendor information in the label's text. This bug has been fixed.
  • METRC Sales Reporting had a bug that was reporting negative sales dollar amounts. Affected sales are sales with discounts applied between 4/25/19-5/8/19. This bug has been fixed to prevent further occurrences. We are working on a batch fix for affected records.
  • The new Pre-Roll button had a bug where it was creating the METRC pre-roll admin item incorrectly. This bug has been fixed.
  • Update: There is now a quick Archive button on the Products page. Just click the INVENTORY quantity to expand the JAR view and click the Archive Package button to quickly archve packages without leaving the products page.
  • Private Cloud Customers will see this update in their systems on Friday 5/10/19.

  • We updated the way that we create labels today.
  • If you are having issues prining labels please let us know right away. 
  • We received reports of a problem wih the new package intake page. This has been fixed. 
  • Labels are now free form text fields but you can continue to enter test information the old way by clicking the new "Show Test Results Fields" button.
  • Please let us know if you have quesions about this new update.

  • We completely rebuilt labels. Now when you edit a package you will notice a free form label text field. The system has pre-populated this test field with the data already in your system.

Partial Update Posted and Outage

Outage: Yesterday we experienced a service outage from 7am to 8:15am. Our SSL secure encryption certificate expired yesterday morning causing an error to appear on OMMPOS. Thank you to the store's who texted us a heads up yesterday morning.

  • We are still working on the METRC pre-roll button. We have added some new features to make METRC and website management easier.
  • The Tech Support button on the main menu now supports website editing, event log reading and METRC ADMIN access. Employees have to receive permission to use these features.
  • METRC Package Editing Tab: A new Metrc Package Editing Tab has been added to the product inventory page. It is now possible to make adjustments directly to METRC from OMMPOS.

Sales Timestamp was showing slightly inaccurate sales times. Fixed.

OMMPOS API was reporting GROSS sales values to METRC. We have fixed this to report NET sales figures to METRC. 

The View Archived Sales tab on the Upload Sales to METRC page has been updated to allow you to view past sales from any date.

OLCC Commissioners Adopt Marijuana Rule Changes

Under the rules change Oregon Medical Marijuana Program cardholders or a designated caregiver will be allowed to purchase a larger amount of marijuana during a single transaction.  In August 2018, after noticing suspicious purchase activity in the state’s Cannabis Tracking System, the OLCC reduced the daily purchase limit to one (1) ounce for OMMP cardholders.

The rule changes approved by the Commission take effect on December 28, 2018.

Key elements of the rules changes include: 

  • Creating a denial basis for licensees who fail to complete the renewal process, and for license applicants found to have an unauthorized interest in a licensed business;
  • Ending the issuance of new licenses to processors as alternating proprietors (shared kitchen) on the same licensed premises for applications received after January 1, 2019, but grandfathering all current processors in alternating proprietorships;
  • Clarifying camera coverage for waste material and amending the penalty structure for violations based on the amount of missing camera footage and the number of offenses;
  • Redefining the allowable shape of canopy areas a producer may have and including an allowance for producers to obtain a professional survey in lieu of the quadrilateral shape requirement;
  • Allowing wholesale licensees to provide retailers with samples from product lines originating from multiple licensees;
  • Increasing trade sample amounts for cannabinoid products, and allowing licensees to share trade samples with employees as long as the transaction is tracked in the Cannabis Tracking System;
  • Increasing medical patient purchase to eight (8) ounces of usable marijuana per day and no more than thirty-two (32) ounces per month;
  • Clarifying that a retailer can only sell a customer five (5) grams of an inhalant per day; and
  • Allowing retailers to apply for the ability to deliver to patients and primary caregivers throughout the state, even in opt-out jurisdictions.

OMMPOS Updates

We are developing a lot of cool stuff over here at Marijuana Software and I wanted to share some of the developments with you and get your feedback.

We have intergrated with AnD and Star Micronics model scales. Now that we can talk to these scales the question is how to get the scale data to the POS which is a website? We have come up with 2 solutions. IoT and the first OMMPOS App. A lot of people have said to us 'This thing needs to be an app on the computer.' We are building a new sales screen app that integrates directly with your scales and printers. We are very excited about this development. We are also launching an Internet of Things (IoT) service that will transmit your scale data to the regular OMMPOS sales screen in real-time. Pretty cool. 9:15 Outtages

Update 11/12/18 We tried to restart the intergration this evening but it had te same 9:15 result so we shut it back down and we are putting additional measures in place.

11/11/18 For the past several nights we have experienced 20 minute system outtages at 9:15 pm. We have traced the cause of these outtages to one of our integration partners and stopped the problem from happening this evening. Label Server Rebooting

Bottle Bill information from OLCC

How does Oregon’s beverage container redemption system work? In general, a distributor charges a 10-cent deposit when it delivers beverages covered under Oregon’s Bottle Bill to a store, then the store charges a 10-cent deposit when it sells those beverages to a customer.  When a customer returns the empty containers to a store or redemption center, the store pays the customer 10 cents per container, and when the store returns the empty containers to a distributor, the distributor pays 10 cents per container to the stores.    


What is the refund value per container? The Oregon refund value on redeemable containers is 10 cents. 


What kinds of beverages are included in Oregon’s Bottle Bill and have a 10-cent refund value?  The beverages listed below have a 10-cent refund value if they are in glass, metal, or plastic bottles or cans in the following sizes:
Three liters or less (these are beverages that were included in the Bottle Bill prior to January 1, 2018):

● waters
● carbonated soft drinks
● beer and malt beverages (includes alcoholic kombucha made with malt syrup; if it is made with cane sugar it is considered to be wine and is excluded from the Bottle Bill)

From 4 ounces up to and including 1.5 liters (these beverages were added to the Bottle Bill on January 1, 2018): ● other non-alcoholic beverages (includes but is not limited to tea, coffee, juice, energy and sports drinks, and non-alcoholic kombucha) ● other alcoholic beverages (includes but is not limited to hard cider up to 8.5% alcohol by volume; excludes distilled liquor and wine) ● marijuana beverages

Important Information About OLCC Notices

Recently many of our retailers received notices from the OLCC indicating that one or more over the limit sales had occurred.

The notice instructed you to correct the problem in Metrc. We have received many phone calls about what these notices means and why they were sent.

Here are the quick answers.

Why Did I Receive an Email From the OLCC?

1. The vendor that you received the product from manifested that product incorrectly in METRC.

2. OMMPOS adjustments get reported to METRC as $0 sales. An adjustment over the daily limit might have caused this letter.

How Can I Fix this Issue?

If this issue was caused by an OMMPOS adjustment

  • Look the adjustment record under METRC > Packages
  • Void the sale.
  • Adjust the package directly in METRC.
  • Archive the package in OMMPOS if appropriate.


If this issue was caused by the vendor manifesting the package incorrectly,

  • Contact the vendor and have them correct that ITEM in METRC. According to the OLCC this will cause a cascade correction that will fix the issue for all licensees impacted.

OLCC Over the Limit Letter

Some of our licensees have received letters from the OLCC indicating that an over the daily limit sale may have occured. This notice appears to be an error on the part of the vendor having specified the unit weight as 6,036 grams. If you have received a letter from the OLCC please do the following:

  • Look up the receipt # in METRC by logging in and going to Sales > Receipts
  • Verify the product sold in the receipt
  • Contact the vendor to have them correct the package information
  • Contact the OLCC by email and provide the details of the package discrepancy.

OLCC Compliance Education Bulletin

The OLCC has added a “Bulletins” section to its Recreational Marijuana Program website with important information for licensees.

The bulletin is part of OLCC’s compliance education.  It is important that you read it, and understand it. If you don’t understand it please contact the OLCC for help.

Failure to understand and follow the information contained in this bulletin could result in an OLCC rules compliance violation affecting your ability to work or operate your business.

Bulletin CE2018-05 covers the following issues:

  •   Upcoming enforcement based on Metrc data
  •   How to verify test data in Metrc prior to receiving or selling an item

METRC Is Back Up

Updated 7/5/18 5:22pm: Metrc reporting appears to have come back online yesterday evening. Please continue reporting sales normally.

We have received reports that Metrc Reporting is temporarily down and Metrc support is offline. We recommend that you continue to do normal order of operations and report your sales to Metrc as soon as Metrc comes back online.

OLCC to Freeze New Marijuana Applications on June 15th

We communicated with Mark Pettinger OLCC Marijuana Spokesperson by email about the upcoming application freeze. 

  • Does this pause apply to all licenses types including applications for Marijuana Handlers cards?  It applies to all license types, but NOT Marijuana Worker Permits

  • Do would-be applicants still have until June 16th to get new applications in for review?  Would be applicants have until close of business Friday June 15th to submit an application and have considered in the current flow of submitted applications.  Beginning June 16th we’ll still accept applications, except we’re going to set them aside and won’t process them until we finish all those that we already have.

  • How long is this pause anticipated to take?  Sometime into 2019

Issue with Metrc Uploading

It looks like the Metrc upload issue was resolved by 10pm last night. If you have not yet uploaded your sales to Metrc please do so right away.

Update 7:47 PM

We have confirmed that this error is coming from Metrc. We are standing by for an update from the Metrc API team. I advise waiting until tomorrow morning to upload your sales by which point Metrc will hve hopefully fixed the issue.

There appears to be an issue preventing Metrc sales uploading. This issue appears to be happening at Metrcs end. We are in communication with Metrcs API support team now and they are aware of the issue. 

It is possible to report your sales using the CSV function on the Upload Sales to Metrc page. We recommend using this option only as a last resort.

  • Fixed a display issue causing the metrc quantity to display incorrectly on the Product > Inventory page.
  • Fix a bug that displayed an error when UNDO was pressed on adjustments.
  • Fix a bug that was preventing RETURNS.

Compliance Update Notes Part 2

We just posted an update at 11:49 AM this morning that changes/fixes a couple of important things.

  • The Sales page has been changed. To search for customers key in their name or ID# and press ENTER.
  • The Refresh Metrc Packages button has been moved to the Metrc Package Intake Page. This button had an error in it that could cause you inventory to display the wrong numbers. If this is the case please Refresh Metrc Packages and select "Past Year" as the option to correct this issue.

This past update should increase system speed noticibly. Please let me know if you have any questions.

Compliance Update 2 Notes

We made some changes this morning to the way our METRC buttons work to improve system performace.

  • The Refreh Metrc Packages button has been removed from the Products page. This button is now on the Intake Metrc Packages page. Use this button to help you retrieve new package intake data.
  • On the Products page clicking a number in the METRC column will cause that Metrc number to be refresh from the Metrc server
  • When uploading sales to Metrc we have limited the upload to ony display 100 sales at a time. After uploading all of your sales, refreh the Metrc upload page to make sure there are not any left. Keep uploading until your sales upload queue is empty

Fixed: Metrc Package Refresh

Our Metrc Refresh Packages functionality was unavailable for part of today. This happened because of ongoing changes to the METRC API.


METRC has been making changes to their API in a way that has occasionally affected OMMPOS functionality. Last month METRC made a change that affected the way we retrieve package information. It took us a week to respond to this sudden change. METRC made another change today that also affected Refreshing Packages. This time we addressed the change within 1 hour of being notified. Refreshing Metrc Packages works normally again.

New Delivery Workflow

Now from the Sales screen if you start a new order by clicking the DELIVERY button you will be able to select a destination customer and then print a delivery manifest.

Oregon Secretary of State Marijuana Audit

The Oregon Secretary of State conducted an audit of the OLCC and the Cannabis Tracking System (CTS). Below are some highlights from the audit.

"Many of the issues identified in the audit were well known to OLCC, however the work accomplished by vendors and the OLCC has created a strong knowledge base, a solid framework to build upon with IT systems that provide a greater degree of accountability and licensee oversight. Because of the major commitment of staff time, these IT systems have served the state well and at a moderate expense."

"The recreational marijuana program is still growing with more than1,200 new applications moving through our licensing approval process. Applicant interest in licensing continues to exceed expectation, cannabis supply is robust, and low consumer market prices are directly challenging illegal market sales in Oregon. As well, the recreational system’s growth in sales to people who hold medical cards shows the regulated system can play an important role in providing reliable access to medical marijuana products."

"The audit points to several data reporting compliance issues related to timely entry of data. The OLCC will be systematically issuing fines based on violations that can be proven by data recorded in the CTS system or the absence of data by failing to record it, such as not meeting a requirement to account for a marijuana crop’ moisture loss within 45 days of harvest. Further build out of CTS will provide staff the ability to be routinely alerted to this type of violation, and potentially trigger a licensee user alarm. The OLCC is exploring how modifying the IT system and requirements user the Administrative Procedures Act (APA), that protect due process, can be integrated to auto-generate citations based on compliance failures to properly and timely record data. Similar to a “speeding ticket,” with this type of sanction the accumulation of too many ticket would result in the loss of license. In the meantime, the OLCC is manually monitoring data for timely entry and analyzing it for potential action against violators."

Package Intake

  • We added a new Import All button under Products > Intake Packages. This button will auto intake all visible packages.
  • The issue on the Intake Packages page that required a refresh after each intake has been fixed.
  • The Refreh Metrc Packages button has been updated to fix a bug where Metrc quantity data was not being displayed for all products.

Metrc Package Synch Issue Fixed (For Real This Time)

The update that we posted last night to fix the Metrc issue had its own issues so werolloed the updateback. We found what went wrong and fixed it. Metrc reporting and package information should now work properly again.

A recent change to the METRC API prevented some store from seeing correct numbers under the Metr column of the Products page. This issue may have also resulted in old packages looking like they needed to be re-imported. This issue has been fixed. We are sorry for the inconvience. Guidelines for ODA Hemp Producers, Handlers and OLCC Licensed Processors

The OLCC has created a separate section on its Recreational Marijuana website about the Hemp program where information about this new process can be found.

ODA producers and handlers, who want to sell hemp and hemp products into the OLCC market, will need to obtain an Industrial Hemp Certificate.  Step-by-step instructions on how to obtain the certificate can be found here.

OLCC processors, who want to process hemp or hemp products, are required to obtain an Industrial Hemp Endorsement.  Step-by-step instructions on how to obtain the endorsement can be found here.

The required forms can be found on the Hemp page and the Forms & Publications page of the OLCC website.

OLCC Launches Marijuana Retailer Minor Decoy Checks

Bend Licensees Pass OLCC Check for Sales to Minors

Portland, OR -- The Oregon Liquor Control Commission has conducted the first of its statewide minor decoy operations to determine if marijuana license retailers are complying with state laws and OLCC regulations ensuring minors aren’t able to enter the business to purchase marijuana products.

On December 19, 2017 OLCC marijuana inspectors visited 20 marijuana retailers in central Oregon, and all of the 20 businesses visited in Bend and La Pine passed a check for prohibiting sales to a minor volunteer.

“That our licensed retailers in central Oregon scored 100 percent on refusal to sell marijuana to a minor is a sign that this segment of our regulated industry understands the importance of compliance,” said Steve Marks, Executive Director of the OLCC.  “As we continue these checks I hope that this result will be reflected across the state.”

Sale of marijuana products to anyone under the age of 21 is a violation that for a first offense could result in a 10 to 30 day license suspension, or a fine of $1650, depending on whether or not the sale is intentional.  Failure by a marijuana licensee, or its employee, to check a customer’s identification before the attempted purchase of a marijuana product is a violation that could result in a seven (7) day license suspension or a fine more than $1100. 

During the sales checks, a minor volunteer attempts to enter a licensed marijuana retailer and/or purchase marijuana products from a licensed business to see if staff are checking ID’s correctly and refusing entry to anyone under 21.  Commission inspectors supervise the minor volunteers.  The volunteers carry their own legal ID that identifies them as under 21 and do not disguise their age or lie to encourage the sale of marijuana.   The Oregon Driver license for a minor carries a red border around the picture with the words “Minor Until” followed by the date of his/her 21st birthday.

The OLCC tests licensed marijuana businesses throughout the year, with each licensed retailer receiving a minimum of one visit per year.  The OLCC offers a free training course on how to check ID’s and identify false identification.

“This is part of our stepped up compliance and enforcement activity,” said Marks.  “We’re working to make sure that all segments of our regulated market are living up to the requirements of their license, and the expectations Oregonians have that they will act responsibly and follow the law.”

The Oregon Cannabis Commission was established in the 2017 legislative session through House Bill 2198

The mission of the Commission is to provide advice to the Oregon Health Authority with respect to the administration of ORS475B.400 to 475B.525; and the Oregon Liquor Control Commission with respect to the administration of ORS475B.010 to 475B.395, as those statutes pertain to registry identification cardholders and primary caregivers.

The commission is tasked with determining:

  • A possible framework for future governance of the Oregon Medical Marijuana program;
  • Steps to address research on cannabis in areas of public health policy and public safety policy;
  • Agronomic and horticultural best practices;
  • Medical and pharmacopoeia best practices;
  • A long-term plan to ensure cannabis will remain affordable to persons with debilitating medial conditions; and
  • Monitor and study federal laws, regulations and policies regarding marijuana.

OLCC Cup Competition Rules - Compliance Education Bulletin

How to Enter Samples into a Cup Competition

Only Retailers can sell or give directly to the public. Producers, Processors, Wholesalers, and Labs cannot sell or gift to non-licensees.

The only compliant way for Cup Competition samples to be provided to judges is for the items to be purchased at an OLCC Retailer location. As a licensed producer or processor you can transfer items to an OLCC Retailer within Metrc, and those items can be purchased at cost by a judge or competition organizer for consumption in the judges’ or organizer’s personal residence. The retail store may charge a discounted price for the marijuana items or give it away free if the customer is an OMMP cardholder.

Most commonly, we have heard licensees say that they intend to use the “In-house Quality Control” adjustment reason in Metrc to enter samples into competition. This is not compliant. Using a licensee’s “quality control” allowance to remove product from the system and provide to individuals would be circumventing the rules and would not be a valid method of entering into a competition. Quality Control samples are intended for quality improvement purposes within a facility, not for providing free product to individuals off the licensed premises.

Any attempt to use adjustments – of any kind – in Metrc for purposes of entering samples into a cup competition would be a violation of OLCC rules.  

Booths at a Cup Competition

Under Oregon law, no consumption is allowed in a public place. Any location with an OLCC liquor license would be a public place, even if the venue is specifically reserved for a cannabis event. If the location is not licensed to sell liquor, whether it is considered “public” is determined by the local jurisdiction. For more information on what is and is not allowed regarding consumption, see OLCC’s “Consumption, Gifting, and Giveaways” guide.

However, with prior approval, an OLCC licensee can set up a booth at an event and have limited amounts of marijuana items on-site for display only. The event as a whole would operate as a “promotional event” in which OLCC licensees with prior approval may participate.

We called the OMMP to find out.

The OMMP directed us to the OLCC's Marijuana information hotline (503-872-5000).

When we called the OLCC hotline we got the following answer (paraphrased)

"Yes, this most recent legislative session did change the rules so that OMMP producers will be able to sell to OLCC Rec facilities. The rules have been updated but there are still no mechanisms in place to implement the new rules. Until we have a chance to update these mechanisms we will be operating under the old rules where OMMP is not allowed to sell to OLCC. We anticipate that we will have a chance to update this mechanisms around the beginning of the year 2018."

So, yes the rules have changed to permit OMMP Growers to sell to OLCC Dispensaries but you can't do it yet.

Marijuana Product Transfers

No licensee may receive marijuana items from outside the licensed OLCC system 

Download Bulletin CE2017-13 from the OLCC Recreational Marijuana Program website which illustrates what products can be transferred.

  • All marijuana items must be tracked and transferred within Metrc.
  • The only “unsourced” items that can be entered into Metrc are start-up inventory that has been approved by the Oregon Liquor Control Commission, or producers’ immature plants and seeds during their first 90 days of licensure.
  • All license types can transfer waste items to each other; waste items must be tracked as waste in CTS and may never become a “usable” product.
  • All license types can make returns (the original product purchased) to the license they directly bought the product from.
  • A joint on its own is considered usable marijuana.
  • A joint with anything added, including kief, is considered a marijuana product. 

Each license type has specific privileges for the transfer of marijuana and marijuana products

Tax E-File Error

We have confirmed that there was an error in the quarterly tax e-file that may have resulted in an overreporting of your quarterly taxes. You may have paid too much tax to the Department of Revenue. We have confirmed that discounts were not being removed from reported taxes in the quarterly report e-file. We recommend that you refile both 1st and 2nd quarter 2017 quarterly returns.

Updated Printing for Android and IPad

We have updated the label print buttons in the POS to better support IPad and Android label printing. Android printing is now enabled using the Star Micronics Star PassPRNT app. IPad printing is enabled using the Star WebPRNT Browser app.

Releafapp.com (New API Partner)

We have partnered with the Releaf App. Use the Releaf App to track the effect of your medication session. Receive detailed feedback on the effect of different strains. The Releaf App can tie directly into your OMMPOS inventory to allow customers to provide feedback on strains in your menu. Find the Releaf App in your Apple and Play Store. With Expanded Testing Capacity in Place, Sampling & Testing Procedure Reverts to 100 Percent Batch Testing

Beginning today, August 30, 2017, every batch of usable marijuana (flower and leaves) must be tested directly for pesticides according to the Oregon Health Authority’s testing rules in order to be compliant. This includes untested product that was collected for sampling prior to August 30.

Some temporary rules regarding the sampling and testing of usable marijuana  have expired, and Oregon Liquor Control Commission Recreational Marijuana Program licensees are required to follow updated OLCC and Oregon Health Authority rules.

This reminder follows an August 11, 2017 OLCC Compliance Bulletin CE2017-09 sent to Recreational Marijuana Program producer and laboratory licensees explaining the rules adjustment.  The bulletin is also posted on the OLCC Recreational Marijuana Program website.

The Oregon Liquor Control Commission issued an order to limit pesticide testing of usable marijuana meant for retail sale to consumers on October 3, 2016.   At that time, OLCC staff found that there was insufficient lab capacity for 100% batch testing of usable marijuana for pesticides. On March 3, 2016, the Commission made a similar determination and extended temporary rules to allow for the continued practice of testing one-third of the batches.

The Commission will continue to monitor market flow and respond to any issues that arise with the expiration of the temporary rule.

Subject: SB 1057 Decision and Tracking Requirement

During the 2017 Legislative Session, the Legislature passed SB 1057 which requires OMMP registered grow sites (except as exempted below), processors and dispensaries to decide to stay registered with OMMP or become licensed by OLCC. Registrants which remain registered with OMMP will be required to track the production, processing, and transfer of all marijuana items using the OLCC Cannabis Tracking System (CTS) and pay a new fee for using CTS.

Exemption: If you are a patient growing for yourself and there are no more than 12 mature plants and 24 immature plants at your grow site you are not required to track in CTS.

A notice of this new requirement and a form will be mailed August 30, 2017.

 Each registrant will be required to, no later than December 1, 2017, provide notice on a form prescribed by OMMP of their decision to:

  • Remain registered with OMMP, use the CTS and pay an additional fee of approximately $480 (additional info on CTS will be available in early 2018); or
  • Apply for a license with the OLCC. A complete application must be submitted to OLCC before January 1, 2018; or
  • Indicate they are a patient growing for themselves and there are no more than 12 mature plants and 24 immature plants at the grow site. A grow site where a patient is growing for themselves and where there are not more than 12 mature and 24 immature plants is exempt from CTS tracking.

 If a registrant does not notify OMMP of their decision by December 1, 2017, the registration will not be renewed.

 If the registrant notifies OMMP with the decision to get licensed with OLCC but do not apply with OLCC by January 1, 2018, the registration will not be renewed.

Additional Grower Info
All growers at a grow site must collectively make the decision to remain registered with OMMP or move to OLCC and submit only one form to OMMP. Submitting more than one form for a grow site may result in registration not being renewed.

METRC API Bulletin

Translation: If you make a big inventory goof using OMMPOS you have to use 1 of these 3 new adjustment reasons directly in METRC.

We have an important update. Three (3) new adjustment codes have been added into Metrc for licensee use. These adjustment codes are to be used by licensees when an error has occurred that creates a discrepancy between a licensee’s chosen system and Metrc, that requires an adjustment to be made to information in Metrc.     
 
• API Adjustment Error - (When an adjustment is made erroneously in both the API and in Metrc) Alaska, Colorado & Oregon

• API Conversion Error - (when amounts are not set up properly or aligned in the POS system and Metrc) Alaska, Colorado & Oregon
 
Licensees have been instructed to use these new adjustment codes when discrepancies exist between 3rd party systems and Metrc, as opposed to standard package adjustments that are designed for Licensees use to report errors when entering information into Metrc directly. Licensees have also been instructed to report any instances of instructions to ignore use of these adjustment codes by 3rd party solution providers. These codes are an important tool designed to help us define and work with our integration partners to resolve issues or discrepancies and help Licensees maintain compliance.

  • Budtenders MUST click the new Open POS button before you can sell.
  • Budtenders can now answer the question "How much of this can I buy for $20?"
  • Store Managers can assign inventory into a specific terminal. Click the AssignBudtendersToPOS check box in your Store Settings and Budtenders will only be able to sell out of terminals that they are logged into.

It's Our Anniversary

June 1st 2017 is our 2 year anniversary. When we signed up our first customer OMMPOS was just a very basic system for OHA dispenaries. From that time to this we became the first POS system in Oregon to be certified for Metrc. We were the first system in Oregon with compliant receipts and labels and the first system in Oregon to comply with the rapid changes in Oregon law. UPDATE:The problem appears to have happened because today is our METRC anniversary. 1 year ago today we received our Metrc API Key. the first POS in oregon to do so. it looks like our Metrc API key expired today andhad to be reissued. The problem has been resolved and you can now upload your METRC sales normally.

Deadline to Wipe Customer Data is May 18th

On Monday, April 17, Oregon Governor Kate Brown signed SB 863 into law. The new law prohibits OLCC licensed marijuana retailers from recording, retaining or transferring information contained on a passport, driver’s license, military identification card or other identification card.

The Deadline to clear the personal recreational customer information from your store is May 18th. We have added a new button "Sanitize Customer Data" under Store settings. This button will erase the names, addresses and id numbers of all of your recreational customers. Reminders on Marijuana Tax Compliance

Here are some helpful reminders from the Department of Revenue for staying in tax compliance and making payments:

 All licensed retailers must register their businesses for the marijuana tax program. You can register by either submitting a paper form or using our Revenue Online registration option at www.oregon.gov/dor/revenue-online. If your business isn’t registered, you can’t make payments with us because we won’t have a place to apply your payments.

Each retail location needs a separate registration, tax account, and quarterly tax return. You can access all of those accounts under a single Revenue Online login. If all locations use the same FEIN, this will occur by default, and you’ll be able to access all accounts as long as you can provide the information required for authentication. To access to those accounts, click “Add access to account” under the “I want to” menu.

If each location uses a different FEIN, you can access those as “third party” or “client” accounts from your main account. To access those accounts, click “Add third-party access” under the “I want to” menu.

Licensed retailers must file their returns electronically through Revenue Online. Returns are due quarterly, at the end of the month following the last day of the quarter. For example, the first-quarter returns are due on the last day of April. Returns must include total sales, by product and by month for both medical and recreational sales. It must also include the total amount of tax-exempt sales (medical). The system will then calculate the taxable sales and taxes due. This calculation gives you the opportunity to double-check your quarterly numbers.

Although returns are quarterly, payments are required monthly. You can pay in cash or by check or money order. You can mail check or money order payments, or you can deliver it person. We only accept cash payments at the main Department of Revenue building in Salem, and you’ll need an appointment. You can schedule an appointment by calling (503) 945-8050. Payments are due at the end of the month following the month of sales. For example, taxes collected in January are due by the end of February.

Timecard bug Fixed

2017 Q1 Quarterly Tax E-File Available

The 1st Quarter Tax E-File for 2017 is now availale. We have added a direct link to the Oregon Department or Revenue. E-File your quarterly taxes in less than 10 minutes.

We fixed an issue with the E-file so that it can now be imported directly into Revenue Online. Before you had to open the E-file in Excel and save it as a newer Excel file. This problem has been fixed and you can now import the E-file directly.

OLCC Approves Medical Bump-Up Canopy for Marijuana Producers

Establishes Sharing Framework between Producers and Patients

Portland, Oregon – The Oregon Liquor Control Commission today approved rules allowing growers licensed in Oregon’s Recreational Marijuana Program to grow marijuana specifically for Oregon Medical Marijuana Program (OMMP) cardholders.  Under this “medical bump-up” arrangement recreational producers will be allowed to grow additional canopy above what is allowed in their OLCC license.

The new rules allow producers to enter into agreements with OMMP cardholders, however a medical cardholder can only have one assigned grower.  Producers that decide to add medical bump up canopy can transfer useable marijuana to an OMMP cardholder.

If a cardholder allows, a producer may transfer excess to other cardholders and caregivers, and OMMP dispensaries and processors.  All production and transfer of excess product is required to be tracked in the Cannabis Tracking System (CTS). 

“This will be the first medically grown marijuana in Oregon under regulations that meet the compliance guidelines of the federal Cole Memo,” said Marvin Revoal, Acting Chair of the OLCC.  “It’s important that we keep legally produced marijuana from being diverted to the illegal market, and again Oregon’s leadership shows that both medical and recreational marijuana can be regulated together.”

The OLCC already allows the sale of medical grade marijuana products by its licensed retailers and those products amount to about 14% of sales in the OLCC regulated environment.  Under the bump-up rules up to 25% of the yield grown for an OMMP cardholder can be sold to OMMP processors and dispensaries.

Addressing the concern voiced by patients, doctors, and medical marijuana advocates that the three pound limit would create a medicine shortage for some patients, Commissioner Pamela Witherspoon called on the Commission to adopt an exception process for patients who need more medicine.

Steven Marks, the Commission’s Executive Director said the agency would monitor patients’ ability to obtain their medicine – especially those with serious illnesses, and act to ensure patient access to medicine either in partnership with the Oregon Health Authority, or within the OLCC’s own rulemaking authority.

“This approach strikes a balance in that it will cover the need of the majority of OMMP cardholders,” said Steven Marks, Executive Director of the OLCC.  “At the same time the OLCC wants to help patients who are seriously ill be able to obtain whatever amount of cannabis-derived medicine they need to treat their illnesses and help them maintain or improve their quality of life.”

The OLCC will monitor the implementation of the bum-up canopy rules and if necessary adjust the rules as the agency learns more from producers and OMMP cardholders who participate in the bump-up program.  The bump-up rules take effect on May 1, 2017.

We recently updated the product procing to automatically include tax. After talking to a number of you we understood that we needed to make this feature optional. We have reverted pricing back to the pre-tax price by default. If you would like to enter your product prices to include tax login to the store settings and click the "Include Tax in Price" option.

There is also a new Inventory Report on the Reports page that combines Stock and Inventory in one view.

Now You Can Sell Without Tracking Customer Data

 Oregon Governor Kate Brown signed Senate Bill 863 into law on April 17, 2017.

SB 863 prohibits marijuana retailers from recording, retaining or transferring information contained on a passport, driver’s license, military identification card or other identification card. 

We have updated OMMPOS so that you can make sales to customers without tracking their personal information. We have made our check-in queue optional. You can just jump straight into a sale without having to check-in a customer. You can even create an anonymous membership card to track customer loyalty.

We have added other updates like improved product pricing. Now you can specify the price of your products to include tax. OMMPOS will figure out the rest.

You can also track the weight of your jars when doing inventory audits.

Collection of Customer Data Ends; Previously Collected Information Must Be Destroyed

Oregon Governor Kate Brown signed Senate Bill 863 into law on April 17, 2017.

SB 863 prohibits marijuana retailers from recording, retaining or transferring information contained on a passport, driver’s license, military identification card or other identification card. 

What are marijuana retailers required to do?

Beginning immediately retailers may NOT record or retain customer information gathered from a piece of official identification (e.g. driver’s license, passport) that could identify the customer.

Retailers are still required, prior to completing the sale of a marijuana item to a consumer, to verify that that the consumer has valid, unexpired government-issued photo identification and must verify that the consumer is 21 years of age or older.  See: OLCC Recreational Marijuana Rules (Retailer Operational Requirements: 845-025-2820)

This law does not change licensee reporting and inventory requirements.  Sales and inventory data must still be reported into Metrc daily including an Oregon Medical Marijuana Program (OMMP) card number if selling to a patient or caregiver. 

Destruction of Previously Collected Consumer Information

On or before May 18, 2017 retailers must destroy any previously collected information that may be used to identify a consumer acquired through the production of a piece of legally described identification.  This includes any consumer information that was previously acquired with consent for the purposes of marketing. 

Licensees should NOT delete or destroy information in Metrc. This requirement only pertains to information recorded or retained outside of Metrc.

Exception to Prohibition for Collecting Consumer Information (Opt In) 

Going forward a retailer may retain the name and the contact information of a customer for marketing purposes only, if the retailer:

·       Asks the consumer if they may record the information for marketing purposes AND

·       The consumer agrees in writing to the information being used for marketing purposes.

 This consumer consent does NOT authorize the retailer to sell or transfer the consumer’s personal information.

Quarterly Tax E-File Now Available

1. Login to OMMPOS.com
2. Click Reports
3. Click the "Q1 DOR REVENUE ONLINE E-FILE" link to download your E-file document
4. Save the E-file document to your computer
5. Login to Revenue Online (The Oregon Department of Revenue's website)
6. Click on Tax Returns > Upload
7. Upload the E-file document

Sales to Medical Cardholders

Sales to medical cardholders are not taxed

If you are a licensed retailer selling a marijuana item to an Oregon Medical Marijuana Program (OMMP) cardholder you may not change a tax.   Instead enter the OMMP card number in your Point of Sale system, or the Metrc Cannabis Tracking System, to verify the reason tax was not charged. 

Only retailers that have completed the form “Registration for Sale of Recreational Marijuana for Medical Purposes” are allowed to sale medical grade products.  Medical grade products come from OLCC licensed processors, but contain medical concentration limits; medical grade products can only be sold to OMMP cardholders.  Retailers that are registered for medical sales may also allow an OMMP cardholder, 18 years of age or older, inside their retail establishment. 

Discounting Marijuana Items

OLCC licensed retailers may discount marijuana items. 

Example: a retailer may offer a 20% discount for top shelf product.

The discount rules do not allow a marijuana item to be discounted in correlation with the purchase of another item.  Buy One, Get One Free (BOGO) and customer loyalty cards linked to marijuana products  are NOT allowed. 

Example: A retailer cannot offer buy 2 get 1 for free.

Example: A retailer cannot have a customer loyalty punch card where the customer buys 10 ounces of marijuana and receives the 11th ounce for free.  If a retailer wants to offer a loyalty punch card, it could be,"buy 10 ounces of marijuana and get a t-shirt or hat for free", because the free product is not marijuana.

What are the restrictions in advertising your cannabis business?  

Advertising is publicizing the trade name of a licensee together with words or symbols referring to marijuana or publicizing the brand name of marijuana or a marijuana product.

 Marijuana advertising may not:

 ·       Contain statements that are deceptive, false, or misleading;

 ·       Contain any content that can reasonably be considered to target individuals under the age of 21;

 ·       Encourages the transportation of marijuana items across state lines;

 ·       Assert that marijuana items are safe because they are regulated by the Commission or have  been tested by a certified laboratory or otherwise make claims that any government agency endorses or supports marijuana;

 ·       Make claims that recreational marijuana has curative or therapeutic effects;

 ·       Display consumption of marijuana items;

 ·       Contain material that encourages the use of marijuana because of its intoxicating effect;  

 ·       Contain material that encourages excessive or rapid consumption.

 Advertisements through print, billboard, television, radio and internet must contain the following statements (this does not apply to advertising on apparel):

 Do not operate a vehicle or machinery under the influence of this drug

 For use only by adults twenty-one years of age and older

 Keep out of reach of children

If the OLCC receives complaints about advertising we will investigate.  You should be prepared to verify you are not breaking any of the advertising rules located in Division 25 Administrative Rules.  If you are advertising through television, radio, billboards, print media or internet you must have verification no more than 30% of your viewing audience in under the age of 21.

Label Bug Fixes and Updates

  • We fixed an issue that caused products not to appear on the products page when the only sale of the product was voided.
  • We have fixed a reported issue with printing single labels from the POS screen in FireFox.
  • We have given Stock Managers access to the Vendor database
  • We added support for new label sizes. You can now print labels in 1x3 and 2x4 sizes.
  • We've added Auto-SKUing. You can now print barcoded pre-packaged labels without having to make up your own SKU. Ofcourse, if you have your own SKU system that will still work as well.

OLCC Recreational Marijuana Program Update Reviewed

 Yesterday the OLCC hosted a Marijuana Update meeting. The meeting was attended by approximately 70 Producers, Processors, Wholesalers and Retailers. During the meeting the OLCC explained the breakdown of rules and responsibility between organizations like the OLCC, OHA, DOA and ODOR. After each presenter there was a question and answer session that was very enlightening.
 
New Licenses and License Renewals
 
The OLCC reports that there is a backlog in processing the various applications for licensing. During the first year the OLCC pulled inspectors from the Liquor side of affairs to make up for the backlog of applications. Now those auxiliary resources are returning to normal duty so expect a slowdown in the time that it takes to process a new or renewal application.
 
For those licensees who have a renewal date pending the OLCC recommends that you apply for renewal sooner rather than later. There is a critical 20-day window for renewal. If you apply for license renewal with more than 20 days left on your license, then you can continue to operate even if it takes the OLCC more than 20 days to process your license renewal, however if there is less than 20 days left before you apply for renewal then you will have to close operations after your expiration date until the OLCC is able to process your renewal. Again, apply with more than 20 days on your license and keep operating. Apply with less than 20 days on your license and shut down when your license expires until after the OLCC can process your application.
 
METRC
 
The OLCC warms that there are a lot of reporting irregularities in METRC and that they will be beginning to crack down on these errors soon with fines. The example provided was that of the producer who harvested a plant 6 months ago and never applied a tag. Please be sure to keep your METRC reporting accurate and up-to-date to avoid penalties.
 
Pre-rolls
 
TJ Sheehy of the OLCC says that pre-rolls should always be weight-based. Many dispensaries log pre-rolls as unit or combined-each in METRC but this is incorrect. All pre-rolls should be weight-based.

IT IS NOT NECESSARY TO APPLY YOUR OWN TAG OVER A VENDOR TAG. If you receive a package from a vendor and that package has a package tag you can use the METRC package tag in OMMPOS. You do not need to re-package packages received from Vendors.

The OLCC emphasized that it is the licensee’s responsibility to ensure that ALL employees of your organization are registered in METRC and that all employees who handle Marijuana possess a valid Marijuana Handler’s card.

DEA BANS CBD? FALSE

Basically what is happening is an internal DEA accounting change in how they track Cannabis Extracts.

There appears to be a proliferation of misleading news with the headline :The DEA Just Banned CBD."

We searched the internet and have been unable to find this story on any major news outlets. It is my opinion that this news is false news or at least intentionally misleading.

Here is what we have been able to figure out with 15 minutes of searching with BING.

CBD being derived from Marijuana is a schedule 1 substance under Federal law. States like Oregon, California, Washington, Colorado and Massachusetts will have legal CBD products because Marijuana has been legalized recreationally in these states. In states where Marijuana is not recreationally or at least medically legal it would be illegal to possess CBD products.

Of course the postal service is a federal institution so sending CBD products through the post would violate federal law as would be transporting CBD or any other Marijuana containing product across state lines.

Basically nothing has changed.

Correction to the Monthly Tax Voucher

We determined that we were using an improper value in the monthly tax voucher. The effect being that the monthly tax voucher was reporting a double taxation. This would have resulted in an overpayment of your monthly taxes.

This error has been corrected. The quarterly tax report was reporting correct values. If you compare your total monthly payments to your Q3 quarterly report you should see the amount of your overpayment. You can report this overpayment on your quarterly return. Service Outtage

We experienced a service outtage today from 12:07 pm to 3:00 pm. The cause of this outtage was an interruption in Microsoft's West coast datacenters. We were able to establish East coast datacenters, sychonrinze our data and reroute arround the problem. We have taken steps to make sure that we are not affected by this type of error in the future. Switching From Medical Marijuana Dispensary to OLCC Retail?

 

Tax Rate Changes, New Tax Filing Process Are Coming

The Department of Revenue wants to help the marijuana industry understand the changes in the tax collection process if they convert from operating as an Oregon Health Authority medical marijuana dispensary to a marijuana retailer in the Oregon Liquor Control Commission (OLCC) regulatory environment.

 

 

 

Different Tax Rates for OHA Dispensaries & OLCC Retailers

 

Once an OLCC license becomes effective, the taxes you collect on your customers’ purchases of marijuana and marijuana products will change. The "Early Start" rate now in place for medical marijuana dispensaries is 25 percent, but the retailer rate is 17 percent. You should charge your customers the lower 17 percent rate when your OLCC license takes effect.

 

 

 

Filing Tax Returns – Transitioning from Dispensary to Retail

 

Whether you remain a Medical Marijuana Dispensary or become a Marijuana Retailer you’re still responsible for filing tax returns with the Department of Revenue.

 

What and how you must file depends on when you transition. If your OLCC retailer license takes effect on October 1, 2016, you should electronically file your first retail tax return for the 4th quarter of 2016 on Revenue Online. You should also file your final return as a dispensary for the 3rd quarter of 2016 using Form OR-581.

 

If you’re transitioning at the end of 2016 and your final day of sales as a medical marijuana dispensary is December 31, 2016, and your OLCC retail license takes effect on January 1, 2017, you should electronically file your first retail tax return for first quarter 2017 using Revenue Online, and for the dispensary’s operation for the 4th quarter of 2016 file a Form OR-581.

 

For any other transition scenario, you’ll be required to file two returns for the 4th quarter: one on paper for the 25-percent tax rate and one electronically on Revenue Online for the 17 percent rate.

 

You will want to keep detailed sales records to track when your tax rate changed, so that you can accurately file reports for the two tax rates.

OLCC Creates Recreational Marijuana Packaging & Labeling Video

The OLCC has produced a video version of its Packaging and Labeling workshop.  The video, which runs about one hour, contains information on the requirements for packaging and labeling as well as the submission process to get them approved.

The video can also be directly accessed on the OLCC YouTube Channel.

The OLCC also has also updated the OLCC Approved Package List, as well as produced short update on the packaging and labeling submission process.

Reporting Bugs

We have received reports of some errors in some of our reports. Please read as this may affect the amount of Tax that you owe.

All Sales Monthly Report: We received notice that this report was displaying an inflated number for earned income. This bug has been fixed. Please re-rerun this report to see accurate values for July. The Medical Sales and Recreational Sales reports were unaffected.

DOR Reports: The Monthly Tax Voucher and other reports under DOR Reports were displaying 'Non-Marijuana Items' in the report. This was an error and has been corrected. If you have any questions, please call Raja (971) 276 - 3371.

October 1, 2016 Compliance Deadline Approaching for Packaging, Labeling, Early Retail Sales and Food Safety

Labeling

Starting October 1, 2016, all cannabinoid products, concentrates and extracts must be compliant with labeling rules found in OAR 333-007-0010 to 333-007-0100, see also 333-0081200(8) and 333-008-1740(10). 

For Dispensaries:  Any marijuana items in a dispensary that do not meet the new division 7 labeling requirements on October 1st must be returned to whoever transferred them or the dispensary must dispose of the products. The dispensary must document any returns or disposal of products.

Packaging

Starting October 1, 2016, all marijuana items, except immature plants and seeds, must be packaged per OLCC packaging rules found in OAR 845-025-7000 to 845-025-7060.  Also see OAR 333-008-1200(8) and 333-008-1740(10).  

What does this mean?  

A dispensary or processor who packages marijuana items for ultimate sale to a consumer, patient, or caregiver must transfer all marijuana items in OLCC approved child-resistant packaging starting October 1, 2016. This includes flower and all other marijuana products but excludes immature plants and seeds. A dispensary may use child-resistant exit packaging to comply with the rules. It is a business decision between the processor and the dispensary regarding who should provide the child-resistant packaging.

Early Retail Sales 

A dispensary may only participate in early retail sales until December 31, 2016. OAR 333-0081500(5)(6) 

What does this mean?  

Starting January 1, 2017, an OHA registered medical marijuana dispensary can only sell marijuana items to OMMP patients and caregivers.  Sales made to anyone other than registered patients and caregivers will result in enforcement action against the dispensary.  

After December 31, 2017, if a dispensary wishes to continue selling marijuana items to adults 21 years of age and older and also to medical marijuana patients and caregivers at the same location, they must be licensed by OLCC. Dispensaries and Food Safety

On and after October 1, 2016, all dispensaries that sell edibles must obtain a food safety license from the Oregon Department of Agriculture (ODA). OAR 333-008-1200(9)

What does this mean?

Violations and Enforcement

Any registered dispensary, processor, grower, patient or caregiver that is found to be violating any of the rules may be subject to civil penalties and/or have their registration suspended or revoked. OAR 333-008-2180 through 333-008-2200.

October 1, 2016 Compliance Deadline Approaching for Transferring, Labeling, Concentration Limits, Packaging and Testing

The Oregon Medical Marijuana Program (OMMP) is approaching a compliance deadline of October 1, 2016, for transferring, labeling, setting concentration limits, packaging and testing of marijuana and marijuana products.

The next 60 days serves as a transition period to allow registrants to move into compliance with new rules. All rules related to medical marijuana may be found on the OMMP’s rule page at: www.healthoregon.org/ommprules

Transferring Cannabinoid Products, Concentrates and Extracts

Beginning October 1, 2016, dispensaries may only accept transfers of cannabinoid products, concentrates and extracts from a registered processing site. OAR 333-008-1230(2). On or after October 1, 2016, dispensaries may continue to sell already stocked cannabinoid products, concentrates and extracts that were transferred from unregistered processors to the dispensary prior to October 1, 2016, but the products, concentrates and extracts must meet labeling, concentration limits, packaging and testing rules found in division 7 as outlined below

Testing

Starting October 1, 2016, all marijuana items must be sampled and tested according to OAR 333-007-0300 to 333-007-0490 and OAR 333-064-0100 to 333-064-0110.  On and after October 1, 2016, any laboratory that tests marijuana items must be accredited by ORELAP and licensed by OLCC. Only accredited and licensed laboratories may sample and test marijuana items. A list of accredited and licensed laboratories will be made available on the OMMP laboratories web page. http://public.health.oregon.gov/DiseasesConditions/ChronicDisease/MedicalMarijuanaProgram /Pages/laboratories.aspx  

For Dispensaries:  On or after October 1, 2016, a dispensary may continue to sell marijuana items that were not sampled and tested by an accredited and licensed laboratory if:  The items are transferred to the dispensary before October 1, 2016; The items comply with the concentration limits, labeling and packaging rules found in division 7 of the rules; and The items are labeled with a label that reads “DOES NOT MEET NEW TESTING REQUIREMENTS” in 12-point font, and in bold, capital letters.  

A dispensary will only be allowed to transfer these products to patients, caregivers and consumers until January 1, 2017.  

Concentration Limits

Beginning October 1, 2016, all cannabinoid products, cannabinoid concentrates or extracts must meet the concentration limits as outlined in OAR 333-007-0200 and 333-007-0220. Lowdose cannabinoid edibles sold to retail customers from medical dispensaries during the early start period must continue to meet the definition found in OAR 333-008-1500(1)(k).
